Integrity Commissioner

Each municipal council is empowered to appoint an Integrity Commissioner who reports to Council and is responsible for independently performing the functions assigned by the municipality regarding the application of its Code of Conduct and any procedures, rules, and policies governing the ethical behaviour of members of Council and local boards.

Responsibilities of the Integrity Commissioner

The responsibilities of the Integrity Commissioner include:

  • Conducting inquiries upon receiving complaints concerning matters under the Municipal Conflict of Interest Act and the Code of Conduct.
  • Providing advice to members of Council and local boards regarding their obligations under the Code of Conduct and the Municipal Conflict of Interest Act.
  • Providing educational information to the public, the Municipality, members of Council, and local boards about the Code of Conduct and the Municipal Conflict of Interest Act.

The duties and responsibilities of the Integrity Commissioner are further detailed in Section 223 of the Municipal Act, 2001.

The Integrity Commissioner reports directly to the Council of the Corporation of the Municipality of Markstay-Warren.

Complaint Filing Process

Any individual who identifies or witnesses behaviour or activity by a sitting member of Council or a local board that they believe contravenes the Code of Conduct for Members of Council and Local Boards or the Municipal Conflict of Interest Act may file a formal complaint, subject to the following conditions:

  • A request for an investigation into an allegation that a member has contravened the Code of Conduct must be sent directly to the Integrity Commissioner by email, substantially in the form attached to the Complaint Protocol as Schedule “A.”
  • A complaint must set out reasonable and probable grounds for the allegation that the member has contravened the Code of Conduct.
  • The complaint should include:
    • The name of the member who is the subject of the complaint.
    • The provision of the Code of Conduct allegedly contravened.
    • The facts constituting the alleged contravention.
    • The names and contact information of any witnesses.
    • The complainant’s contact information during regular business hours.
