Sudbury East Building and By-law Services (SEBBS) is responsible for enforcing the Ontario Building Code Act and applicable law as it relates to building projects within the Municipality of Markstay-Warren. Construction may not begin until a building permit has been issued. Go to SEBBS for information on how to build in your community.

Building Permit
A building permit regulates the type of construction allowed in the municipality and ensures that construction within the municipality meets with standards set out in the Ontario Building Code. No matter what the specific project may be, the enforcement of codes is carried out to protect public health, safety, and welfare.
Compliance with Municipal By-Laws such as the Zoning By-law is also evaluated during the review process. The building permit process protects each homeowner’s interests, as well as those of the municipality and helps to ensure that any structural change is safe, legal, and sound.
By obtaining a permit, you can also take advantage of the professional expertise of Building Division staff. Inspectors are good sources of information and can offer suggestions to help solve construction problems, often before they occur.
Building permits are typically required for the following:
- New buildings
- Additions
- Renovations or alterations
- Demolitions
- Prefabricated structures
- Plumbing alterations
- HVAC systems (heating, ventilation, air conditioning)
- Miscellaneous for residential (pools, fireplaces, decks, fences, etc.)
- Temporary buildings
- Installing new windows and exterior doors
- Installing new metal roofing
- Installing new cladding (siding, stucco, etc.)

Septic Systems
Prior to the issuance of a Building Permit for your proposed project, approval from the Public Health Sudbury & District (PHSD) pertaining to your septic system is required if you are:
- Constructing a new building
- Adding a bedroom, sleeping cabin, or washroom
- Increasing the number of fixture units (sink, toilet, bathtub, shower, laundry, dishwasher, etc.), or
- Increasing the total floor area of the building by 15 percent or more.
